Terms of Service

Green Equipment Diagnostics ("GED", "we", "us", "our") is operated by BellTech Software. These Terms of Service ("Terms") govern your access to and use of the Green Equipment Diagnostics mobile application, website, and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By registering, you represent and warrant that you meet these requirements.

2. Accounts and Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.
• You agree to notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or that remain inactive for an extended period.

3. Subscriptions and Billing

GED offers subscription plans through Google Play Billing. All payments are processed by Google Play and are subject to Google Play's terms and policies.

• Free trial: New users receive a 14-day free trial. At the end of the trial, the selected subscription automatically begins billing unless cancelled through Google Play before the trial ends.
• Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Cancellation: You can cancel at any time through your Google Play account settings (Play Store → Profile → Payments & subscriptions → Subscriptions). Cancellation takes effect at the end of the current billing period.
• No refunds: We do not provide refunds for partial billing periods or unused trial days, except where required by law.
• Price changes: We may change subscription prices with reasonable notice. Price changes take effect at the next billing cycle.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Attempt to gain unauthorized access to any part of the Service, servers, or networks.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Upload malicious code, viruses, or harmful materials.
• Share your account credentials with others or allow others to use your account.
• Use automated systems (bots, scrapers) to access the Service without written permission.
• Use the Service to seek, generate, or distribute content that disables, removes, or bypasses emissions-control systems (including DPF, SCR, EGR, DEF, or OBD monitors), defeat devices, or emissions non-compliance procedures.

5. Diagnostic Content Disclaimer

• All diagnostic reports, recommendations, and guidance are generated using AI and publicly available sources. They are provided for informational purposes only.
• Always follow the machine manufacturer's official technical manual and safety procedures.
• Always shut down, isolate, and secure machinery before inspection.
• Never work beneath an unsupported header or near moving, pressurized, electrically live, or hot components.
• Qualified technician oversight is strongly recommended for all repairs.

No Professional Advice. The information provided through the Service is for general informational and educational purposes only. It does not constitute professional mechanical, engineering, or safety advice. You are solely responsible for determining whether any diagnostic step, repair procedure, or parts recommendation is appropriate and safe for your equipment, skill level, and operating conditions.

Assumption of Risk. Operating, diagnosing, and repairing heavy agricultural and construction equipment involves inherent risks of personal injury, property damage, and economic loss. By using the Service, you acknowledge and accept these risks. To the maximum extent permitted by law, BellTech Software and Green Equipment Diagnostics disclaim all liability for any injury, damage, or loss arising from your use of, or reliance on, any information provided by the Service.

When to Stop. If a diagnostic result indicates a critical or severe fault, or if you are not qualified or equipped to perform the suggested checks safely, stop operating the equipment immediately and contact a qualified technician or your dealer.

6. Intellectual Property

All content, software, designs, text, graphics, and other materials provided through the Service are owned by BellTech Software or licensed to us. You may not copy, modify, distribute, or create derivative works from our content without written permission.

You retain ownership of any diagnostic data, photos, and machine information you upload. By uploading content, you grant us a limited license to use, process, and store it solely for the purpose of providing the Service.

7. Third-Party Trademarks and Independence

Trademark Notice. John Deere, the leaping deer symbol, Service ADVISOR, Operations Center, JDLink, GreenStar, AutoTrac, StarFire, PowrQuad, and related marks are trademarks of Deere & Company. Green Equipment Diagnostics is not affiliated with, endorsed by, or sponsored by Deere & Company. Use of equipment brand and model names is nominative fair use for compatibility description only.

Independence. Green Equipment Diagnostics is an independent software product developed by BellTech Software. All diagnostic information is sourced from publicly available standards (SAE J1939), manufacturer service literature, and aggregated third-party repair knowledge. We do not have access to, and do not distribute, proprietary manufacturer diagnostic software, calibration files, or dealer-only technical bulletins.

8. Termination

• We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.
• Upon termination, your right to use the Service immediately ceases.
• Your account data may be retained for a reasonable period for legal, security, or operational reasons before deletion.
• Provisions that by their nature should survive termination (disclaimers, liability limitations, intellectual property) will survive.

9. Limitation of Liability

To the maximum extent permitted by applicable law, BellTech Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless BellTech Software, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. The "Last Updated" date at the top indicates the most recent revision.
